Charter Contract - Flite

  • Charter Terms: Flite Lessons include a trained instructor and a fully charge Flite Board.

    COVID-19 The charter party must be certain they have followed safe practices of social distancing for at least the last 4 weeks, and are in good health. If for any reason the chartering party is uncertain they are in good health, they must notify the Instructor.

      General Rules:
    • All guests shall wear Coast Guard certified personal flotation device (PFD) at all times during the charter lesson. NBC will provide a PFD if you do not have one.
    • Students shall listen to all Instructor's advice and follow any commands given.

    Rain date policy: In the event of extreme or other adverse forecasted weather conditions, the Charter Party and NBC can agree to reschedule no later than 5:00PM the day before the charter.

    The Instructor reserves the right to cancel any charter if he/she feels weather conditions represent a danger to the safety of the passengers.

    Cancellation Policy: If a charter is cancelled more than four weeks before the Charter Party’s scheduled sailing date, the Charter Party will receive a full refund, minus a $50 cancellation fee. If the Charter Party cancels their sail between two weeks and four weeks, the Charter Party will receive a full refund minus 20% of the charter amount. If the Charter Party cancels less than two weeks in advance of their date, all monies paid by the charter are forfeited unless Nyack Boat Charter books another charter on that date. If another charter party takes that date and time period, for an equal or greater amount of money, the original Charter Party will receive a full refund minus the $50 cancellation fee.

    Damage: If any member of the Charter Party causes any damage to their Flite board, Nyack Boat Charter will assess the damage and estimate the cost of repair. NBC will consult with the Charter Party before applying any fees to the credit card.

    Release of Liability, Waiver of Claims, Assumption of Risks

    Charter Party agrees to all terms and conditions contained in the separate Liability Release which is considered a material part of this Agreement and Contract.
